Hypothetically speaking: if you saw something you thought would be good for a tattoo, but it's by a really small company you like / indie artist or something, is it good practice to ask permission about doing so? I realise a) they would never find out, b) would probably be flattered and c) would have no recourse against you regardless, but it seems like it would be a decent thing to do?
